Terms of Service

1. Acceptance of Terms
By accessing or using Trackm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. These Terms constitute the entire agreement between you and Trackm regarding use of the Service and supersede all prior agreements.
2. Description of Service
Trackm is a personal finance tracking application that provides encrypted budget management. The Service allows users to track expenses, income, and net worth across multiple "pockets" (budget categories). All financial data is encrypted using per-user encryption keys derived from user passwords; the Service operators cannot read your financial data.
Critical — Read Before Signing Up: Trackm uses zero-knowledge encryption. At signup you receive a one-time recovery key. If you lose both your password and your recovery key, your data is permanently and irrecoverably lost. There is no password-reset service, no account recovery hotline, and no backdoor. Store your recovery key in a password manager or in a physically secure location before closing the signup screen.
3. Eligibility
You must be at least 18 years of age to create an account or purchase a license. By creating an account you represent and warrant that you are 18 or older. Trackm does not knowingly collect personal information from anyone under 18. If we become aware that an account was created by a person under 18, we will terminate that account and delete any associated data. If you are between 13 and 17 years of age, you may not use this Service.
4. User Accounts
To use the Service, you must create an account by providing a username and password. You are responsible for:
- Maintaining the confidentiality of your password
- Saving your recovery key in a secure location immediately after signup — it is displayed only once and cannot be re-generated or retrieved by Trackm
- All activities that occur under your account
- Ensuring your password is strong and not reused across other services
- Notifying us immediately of any unauthorized use of your account
We reserve the right to terminate accounts that violate these Terms.
5. Payment and Billing
Trackm offers a 30-day free trial with no credit card required. After the trial period, continued creation of new transactions requires a one-time payment of $35 for lifetime access. Your data remains readable at all times.
- The one-time fee grants access for the operational lifetime of the Service (see definition below)
- During the trial, all features are fully functional
- After trial expiration, your data remains readable but new transactions cannot be added without payment
- Payments are processed by Stripe, Inc. and are subject to Stripe's terms of service
Definition of "Lifetime": For purposes of these Terms, "lifetime access" means for as long as the Service remains operational. It does not mean the user's biological lifetime nor an indefinite perpetual commitment.
Refund Policy: Because a full-featured free trial is provided before any payment is required, all payments are generally final and non-refundable. If you believe you are entitled to a refund (for example, due to a billing error or a technical failure that prevented you from using the Service), contact us within 30 days of payment and we will evaluate your request. In the event that Trackm permanently discontinues the Service, we will provide at least 90 days advance notice and a full refund to all accounts created within 30 days prior to the announcement.
6. Data Ownership and Privacy
You retain all rights to your data. Trackm does not claim ownership of any content you input into the Service.
Zero-knowledge architecture: Your financial data is encrypted on the server with a key derived from your password. The Service operators do not hold your encryption key or your recovery key and therefore cannot read, sell, share, or produce your decrypted financial data under any circumstances — including requests from law enforcement, courts, or government agencies. Any legal process served on Trackm can yield only encrypted ciphertext, which is computationally useless without your password or recovery key.
We collect the following non-financial metadata to operate the Service: username, account creation timestamp, payment status, and session tokens. This metadata is not encrypted at the application layer but is protected in transit by TLS.
7. Not Financial Advice
Trackm is a tool for recording and organizing your personal financial data. It does not provide financial advice, investment advice, tax advice, or legal advice. Nothing in the Service constitutes a recommendation to buy, sell, or hold any asset. Trackm does not analyze your financial situation or make recommendations tailored to your circumstances. You are solely responsible for all financial decisions you make. Consult a qualified financial professional before making significant financial decisions.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Attempt to circumvent security measures or encryption
- Upload malicious code, viruses, or other harmful content
- Engage in unauthorized automated access (scraping, bots)
- Interfere with the proper functioning of the Service
- Use the Service if you are located in a country subject to US economic sanctions or are listed on any US government denied-party list
We reserve the right to investigate and take appropriate action against violations, including immediate account termination.
9. Data Encryption and Security Limitations
While Trackm employs zero-knowledge encryption so that only you can access your data, you acknowledge that:
- No security system is impenetrable
- You are responsible for maintaining the security of your own devices, passwords, and recovery key
- If you lose both your password and your recovery key, your data is permanently and irrecoverably lost — Trackm has no mechanism to assist you
- Recovery is entirely self-service: only you, using your recovery key, can reset your password and regain access to your data
10. Service Availability and Backups
We strive to maintain Service availability but do not guarantee uninterrupted access. We perform regular backups of encrypted data to protect against infrastructure failures. However:
- We are not liable for temporary downtime or maintenance periods
- Backup restoration may take time depending on the situation
- Backups contain encrypted data only; they do not help you recover from a lost password or recovery key
- You are encouraged to export your data periodically for your own records
11. Termination
You may request account deletion at any time by contacting us. Upon termination:
- Your access to the Service will be revoked immediately
- Your encrypted data will be retained for up to 90 days for backup integrity purposes, then permanently and irreversibly deleted
- Minimal metadata (email, payment records) may be retained for up to 7 years for legal and accounting purposes, as required by applicable law
- One-time payments are non-refundable upon voluntary account termination
We may suspend or terminate your access immediately if you violate these Terms or engage in harmful conduct. In the event of termination for cause, no refund will be issued.
12. Indemnification
You agree to defend, indemnify, and hold harmless Trackm and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any third-party rights; or (c) any content you submit to the Service that causes harm to a third party.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, timely, secure, or error-free
- Any errors in the Service will be corrected
- The results obtained from using the Service will be accurate or reliable
- The encryption will be unbreakable or that your data is absolutely secure against all possible future attacks
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACKM OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of, or inability to access or use, the Service
- Any conduct or content of any third party on or related to the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Data loss due to a forgotten password, a lost or destroyed recovery key, or any failed recovery attempt
- Service downtime, data loss, or any other failure arising from infrastructure or circumstances beyond our reasonable control
IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF (A) $35 OR (B) THE AMOUNT YOU PAID TO TRACKM IN THE 12 MONTHS PRECEDING THE CLAIM.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is located, without regard to conflict-of-law provisions.
Informal resolution first: Before filing any formal legal proceeding, you agree to contact us in writing describing the dispute and your desired resolution. We will make a good-faith effort to resolve the dispute informally within 30 days. This informal process is a prerequisite to any formal proceedings.
If informal resolution fails, you agree to submit to the personal jurisdiction of the competent courts in the Service operator's jurisdiction for resolution of any disputes arising under these Terms.
16. Changes to Terms
We reserve the right to modify these Terms at any time. For non-material changes (such as typographical corrections or clarifications that do not affect your rights or obligations), modifications are effective upon posting to the Service.
For material changes — including changes to payment terms, data handling practices, limitation of liability, or dispute resolution — we will provide at least 30 days advance notice via email to the address associated with your account. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.

18. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. These Terms, together with any policies referenced herein, constitute the entire agreement between you and Trackm regarding the Service and supersede all prior communications, proposals, or agreements.
